Public-Interest & Educational Resource • Licensed Attorney Network • Verified Using County Records

CalFairEquity.org is an independent, educational public-interest resource — not a law firm or government agency.

Your Post-Foreclosure Rights

Under California law, when a foreclosed property sells for more than the amount owed, the former homeowner and their heirs have a legal right to those remaining funds — known as excess proceeds.

This protection exists to ensure that equity built over years of ownership isn’t lost after the sale. The law requires that a verified claim be filed before the funds can be released.
If no claim is made, the funds are forfeited to the State of California. (Cal. Code Civ. Proc. §§ 2924j, 1510)

How We Help Californians

Educate & Protect

Educate & Protect

Educate & Protect

CalFairEquity.org exists to educate and protect California families from misinformation and unfair practices after foreclosure through transparency, lawful recovery, and verified legal guidance.

Verify & Confirm

Educate & Protect

Educate & Protect

We confirm property records to verify whether excess funds exist, identify who may be legally entitled to them, and prepare clear case summaries so eligible claimants can move forward with a verified legal claim.

Connect & Support

Educate & Protect

Connect & Support

We help connect eligible claimants with independent, licensed California attorneys affiliated with the CalFairEquity.org' initiative who provide free consultations and manage all official legal filings.

Legal Oversight & Process

All verified claims are connected to licensed California attorneys who prepare and file the necessary legal documents under California Civil Code § 2924j.

CalFairEquity.org does not provide legal services — we operate as an educational, public-interest resource to help homeowners and heirs understand their rights and confirm eligibility.

Attorneys in our network maintain active good standing with the California State Bar and can be verified at The State Bar of California. Most handle these matters using a results-based model — no fees are owed unless funds are successfully recovered. There are no costs or obligations to verify eligibility through CalFairEquity.org.

Early Access Options

In some cases, verified claimants may qualify to receive a portion of funds sooner through independent partners. This option is completely voluntary, reviewed by an attorney, and never structured as a loan or credit product.
