Under California law, when a foreclosed property sells for more than the amount owed, the former homeowner or their heirs, if deceased, have a legal right to those remaining funds — known as excess proceeds.
This protection exists to ensure that equity built over years of ownership isn’t lost after the sale. The law requires that a verified claim be filed before the funds can be released.
If no claim is made, the funds are forfeited to the State of California. (Cal. Code Civ. Proc. §§ 2924j, 1510)
